Acceptance of Terms

By accessing or using MovieStacks, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

Service Description

MovieStacks is a subscription-based software service that enables users to manage, catalog, and review their physical media collections. The service provides tools for tracking editions, formats, versions, condition, purchase information, and wishlist items for movies and related media.

Account Registration and Responsibility

To use MovieStacks, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring that your account information remains current and accurate

You may not share your account credentials with others or allow others to access your account. Each account is intended for use by a single individual or entity.

Subscription and Billing

MovieStacks is a subscription-based service. By subscribing, you agree to pay the fees associated with your chosen subscription plan. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your plan).

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the subscription fees. If payment fails or your subscription is not renewed, your access to the service may be suspended or terminated.

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period, and you will continue to have access to the service until that time. We do not provide refunds for partial subscription periods, except as required by law.

We reserve the right to change our subscription plans and pricing at any time. We will provide reasonable notice of any price changes, and you may cancel your subscription if you do not agree to the new pricing.

User Content

You retain full ownership of any content you submit, upload, or create within MovieStacks, including but not limited to collection data, reviews, notes, metadata, and any other information you provide ("User Content").

By submitting User Content to MovieStacks, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, and display your User Content solely for the purpose of providing and improving the MovieStacks service. This license includes the right to:

• Store your User Content on our servers and backup systems
• Display your User Content to you and as you configure it to be displayed
• Process and format your User Content to make it accessible through the service
• Create backups and archives of your User Content

You represent and warrant that you own or have the necessary rights to all User Content you submit, and that your User Content does not violate any third-party rights or applicable laws.

You are solely responsible for your User Content. We do not endorse, support, or guarantee the accuracy, completeness, or usefulness of any User Content.

Prohibited Uses

You agree not to use MovieStacks to:

• Violate any applicable laws, regulations, or third-party rights
• Transmit any malicious code, viruses, or harmful software
• Attempt to gain unauthorized access to the service or other users' accounts
• Interfere with or disrupt the service or servers connected to the service
• Use automated systems (bots, scrapers, etc.) to access the service without permission
• Reverse engineer, decompile, or attempt to extract the source code of the service
• Resell, redistribute, or sublicense access to the service
• Use the service for any illegal or unauthorized purpose

We reserve the right to investigate and take appropriate legal action against anyone who violates these terms, including terminating their account and reporting violations to law enforcement.

Termination

You may terminate your account at any time by canceling your subscription and deleting your account through your account settings.

We may suspend or terminate your account immediately, without prior notice, if you violate these Terms of Service or engage in any conduct that we determine is harmful to the service, other users, or our business.

Upon termination, your right to access and use the service will immediately cease. We may delete your User Content after a reasonable period following termination, though we are not obligated to retain it. You are responsible for exporting any data you wish to keep before terminating your account.

Disclaimer of Warranties

MovieStacks is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The service will be uninterrupted, secure, or error-free
• Any defects or errors will be corrected
• The service will meet your specific requirements or expectations
• The results obtained from using the service will be accurate or reliable

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

To the fullest extent permitted by applicable law, MovieStacks and Twenty Seven Ventures LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or use
• Business interruption
• Loss of goodwill
• Cost of substitute services

Our total liability to you for any claims arising out of or relating to these Terms or the service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Changes to the Service or Terms

We reserve the right to modify, suspend, or discontinue any aspect of the MovieStacks service at any time, with or without notice. We may also add, remove, or modify features and functionality.

We may update these Terms of Service from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the service after such changes constitutes your acceptance of the new Terms.

If you do not agree to the updated Terms, you must stop using the service and may cancel your subscription.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the state and federal courts located in Florida.
